              <text>In February 2008, during a regular NHL season game, Marty McSorley struck Donald Brashear with his hockey stick with enough force to give Brashear a serious concussion.  McSorley was later charged with Assault with a Weapon pursuant to s. 267(a) of the Canadian Criminal Code.  He was later convicted for this offence by Kitchen J. after a trial in the Provincial Court of British Columbia, Criminal Division. This document is the decision of Kitchen J. in the McSorley case.</text>
